Please ensure you read and understand the details of your photo session.
Your photo session:
– Our studio is a family photography studio. This means that in every session, even baby focused sessions, that all immediate family members are welcome (ie parents, siblings and grandparents)
– All decision makers must attend the viewing and design appointment.
– Copyright of images, remains the property of Kapture Photography and its representatives. Any images taken during your photo shoot may be used for promotional, advertising and / or editorial purposes including but not limited to Social Media, Website and Printed Material. If you do not wish for your images to be used, please specify this in your Pre-Shoot Questionnaire.
– To avoid disruption to the photographic coverage and to allow the Studio to
fulfil its contracted duty photographing what is being created for you with your own cameras / devices is not permitted in the studio.
– Whilst all due care will be taken on your photo shoot, The Client agrees that kapture photography and its representatives are released from all and any liabilities. Kapture Photography and its representatives liability is limited to a full refund of any monies paid by the client, which shall be in full and final satisfaction to any damage or loss suffered.
– The Client agrees that they are signing this agreement for all parties involved in the photo shoot including any persons under the age of 18.
– The Booking Fee is not refundable but may be transferable.
Pandemic Inclusions
At Kapture Photography, family is what we are all about, and it is important that we work
together to not only keep your family safe and protected, but also to keep my family and all other families coming to the studio safe as well.
As the studio has newborns and small babies come to visit, it is always disinfected before sessions, linens are always washed in between sessions, and hand sanitiser is always used during sessions.
The exact list of precautions that the studio will be taking and you will need to also participate in are listed below:
– If you or your family has been unwell, or experienced any flu like symptoms in the 7 days prior to your session you are required to reschedule your session.
– Should I become unwell in the lead up to your session, that you understand that your session would also need to be rescheduled.
.- The studio will be disinfected both before and after your session, including any props used.
You acknowledge that pandemics are not covered by Public Liability Insurance, and that your session is undertaken at your own risk and that I, Karen Barber and the studio, Kapture Photography, are released from any claims or damages relating to any pandemic.
ABC COOKBOOK
(a) The Agreement does not grant either party any rights, implied or otherwise, to the other’s Material, content or Intellectual Property Rights. As between the parties, You own all Intellectual Property Rights of the Recipe provided by You to Kapture Photography and Kapture Photography owns all Intellectual Property Rights of the ABCs of Food Book including all Material developed by Kapture Photography.
(b) You grant Kapture Photography a non-exclusive licence to use Your Recipe in the ABCs of Food Book and accept that you are not entitled to any income, royalties or revenue raised from the sale of the book.
(c) You are solely responsible for ensuring that You have all necessary rights, permissions and intellectual property to contribute the Recipe provided to Kapture Photography.
(e) You indemnify, release and hold harmless Kapture Photography from and against any claims or allegations of Intellectual Property Rights infringement or breach of any laws as a result of Recipes provided to Kapture Photography by You
You are signing this waiver on behalf of all people involved in your session, including children under the age of 18 years.
